Bahan bukti : Mahkamah terima permohonan Anwar

Hakim Datuk Mohamad Zabidin Mohd Diah memerintahkan pihak pendakwa supaya membenarkan Datuk Seri Anwar Ibrahim meneliti rakaman CCTV yang didakwa tempat kejadian, jika salinan yang diberikan tidak jelas.

Beliau juga memerintahkan supaya nota pemeriksaan doktor Hospital Kuala Lumpur ke atas pengadu - Mohd Saiful Bukhari Azlan - turut diserahkan kepada pihak peguambela.

Hakim Mohd Zabidin juga mahu pihak pendakwa menyerahkan kepada pihak peguambela kenyataan saksi dari tujuh individu.

Bagaimanapun, mahkamah tidak membenarkan permohonan pihak peguambela untuk mendapatkan sampel DNA yang relevan dan testimoni video Mohd Saiful kepada polis yang dirakam pada 30 Jun 2008.




Sebelum itu, Mahkamah Tinggi menangguhkan prosiding pada jam 10 pagi tadi untuk memboleh hakim membuat keputusan selepas mendengar hujah balas peguambela Edmund Bon dan Amer Hamzah Arshad terhadap hujah ketua pendakwaraya Yusof Zainal Abiden bahawa semua dokumen telah diserahkan kepada pihak peguambela.

Pihak peguambela memohon supaya pihak pendakwa menyerahkan set lengkap dokumen-dokumen asal, kenyataan saksi, rakaman CCTV dan bahan bukti lain yang berkaitan dengan tuduhan liwat terhadap Anwar.

Pembelaan utama Anwar ialah telah menyerahkan notis alibi kepada pihak pendakwa, bahawa tuduhan terhadap Anwar itu satu konspirasi politik, bahawa pengadu (Mohd Saiful) tidak boleh diperayai, bahawa terdapat gangguan pada bukti penting serta bukti pemeriksaan perubatan mendapati tidak berlaku penetrasi.

Sebelum prosiding bermula pagi tadi, peguam R Sivarasa yang mengetuai pasukan peguambela Anwar - selepas Sulaiman Abdullah menarik diri semalam - meminta hakim mmerintahkan pegawai penyiasat Jude Pereira keluar dari dewan mahkamah.

Pereira yang juga hadir dalam prosiding semalam, merupakan saksi utama pihak pendakwa, kata Sivarasa.

Hakim bersetuju dan memerintahkan Pereira meninggalkan dewan mahkamah.

Selepas hakim membuat keputusan terhadap pemohonan mendapatkan bahan bukti berkenaan, mahkamah dijangka menetapkan tarikh sebutan permohonan Anwar untuk membatalkan tuduhan terhadapnya dan menetapkan tarikh baru perbicaraan, bergantung kepada permohonan-permohonan sebelum ini.

Menteri Besar Kedah, Datuk Seri Azizan Razak menyaksikan pelancaran projek itu melalui majlis menandatangani perjanjian antara Merapoh Resources Corporation dengan para pelabur mereka.

Merapoh oil refinery di Yan, Kedah yang bernilai US$10 billion (RM35.7 billion) akan mempunyai kapasiti penapisan sebanyak 350,000 tong minyak sehari, sekali ganda kemampuan kilang yang kedua terbesar di Malaysia iaitu di Melaka.

SHAH ALAM, 15 Julai - Kajian sebuah organisasi bebas di Selangor, mendapati kerajaan Pakatan Rakyat pimpinan Tan Sri Abdul Khalid Ibrahim mendapat sokongan tinggi daripada rakyat Selangor, sejak mengambil alih pentadbiran, 8 Mac tahun lalu.

Kajian yang dijalankan oleh Merdeka Centre di antara 5 Jun hingga 15 Jun 2009 mendapati 60 peratus daripada rakyat Selangor, merasakan Kerajaan Negeri berada dalam hala tuju yang betul dan 63 peratus berpuas hati dengan prestasi Menteri Besar.

Sebanyak 64 peratus rakyat Selangor berpuas hati dengan prestasi Kerajaan Pakatan Rakyat Selangor, selepas memenangi Pilihan Raya Umum pada Mac 2008 manakala 22 peratus lagi tidak berpuas hati.

Mengikut pecahan kumpulan etnik pula, kajian yang mengumpulkan pendapat orang ramai itu mendapati masing-masing dengan peratusan 59 Melayu, 69 Cina dan 69 India, menyatakan puas hati terhadap hala tuju kerajaan pakatan rakyat sekarang.

Antara aspek tahap kepuasan kajian selidik tersebut ialah mereka berpuashati terhadap program kebajikan yang dilaksanakan, ketelusan dan pentadbiran yang cekap serta menolak amalan rasuah dalam pentadbiran baru kerajaan negeri Selangor.

Chua Jui Meng akan sertai PKR?

kemaskini 11:12am Bekas Naib Presiden MCA, Datuk Chua Ji Meng dipercayai akan melompat parti untuk menyertai PKR di satu majlis hujung minggu ini.

Chua telah memanggil mesyuarat tergempar MCA Bakri malam ini di mana beliau dijangka melepaskan jawatan ketua bahagian berkenaan.

Difahamkan timbalannya, Sia Ka Tuan, dijangka akan memangku jawatan ketua bahagian berkenaan.

Ketua Umum PKR, Datuk Seri Anwar Ibrahim dijangka menggunakan kemasukan Jui Meng ke dalam PKR untuk meningkatkan sokongan kepada gabungan pembangkang yang kini berdepan dengan krisis dalaman dan kebangkitan semula BN di bawah kepimpinan Perdana Menteri baru, Datuk Seri Najib Tun Razak.

Usaha untuk menghubungi Jui Meng sehingga tidak berjaya.


Chua, 64, bekas menteri kesihatan dan seorang peguam, mengetuai bahagian Bakri sejak 23 tahun yang lalu.

Beliau bertanding jawatan timbalan presiden MCA tetapi tewaskan kepada Datuk Seri Ong Ka Ting pada 2005 dan Datuk Seri Ong Tee Keat pada 2008.

Anwar gets extra proof, prosecutors to appeal

KUALA LUMPUR, July 16 — Datuk Seri Anwar Ibrahim's defence was today allowed by the Kuala Lumpur High Court to get extra evidence it says the prosecution is hiding in the opposition leader's sodomy trial but prosecutors say they will appeal the decision.

Judge Datuk Mohamad Zabidin Mohd Diah ruled in favour of Anwar this afternoon after spending a total of a day listening to arguments from the parliamentary opposition leader's defence team led by Subang MP Sivarasa Rasiah and the prosecution led by Datuk Yusof Zainal Abiden.

He said there was no provision in law that bars the prosecution or stops the court from providing relevant documents. However, Yusof said he will apply tomorrow to stay the judge's decision before filing an appeal against it at the Court of Appeal.

The judge said the prosecution has 10 days to give copies of CCTV clips of Mohd Saiful Bukhari Azlan in the condominium complex where Anwar is accused of sodomising him in June last year and medical examination notes and chemist notes.

The courtroom was packed to hear the judge's decision after he adjourned hearing earlier this morning. Among those present was Anwar's wife, PKR president Datuk Seri Wan Azizah Wan Ismail.

Anwar told reporters he was happy with the judgment but said the defence had to go through due process as it could not be presumptuous due to past experience.

The 61-year-old grandfather, who stands accused of sodomising his former male aide Saiful in June 2008, has repeatedly claimed he is being denied a fair trial.

The former deputy prime minister, who made his political comeback last year, has also applied to strike out the sodomy charges against him. The judge fixed July 24 to hear that application.

He is also trying to disqualify the present seven-member prosecution team headed by Yusof . He claims they are a part of a “malicious” prosecution handpicked by Attorney-General Tan Sri Abdul Gani Patail, whom he accuses of trying to put an end to his political career.

If convicted, Anwar faces up to 20 years in prison, effectively snuffing his dreams of taking over the federal government.

Earlier in the morning, there was the first lively exchange between the defence and prosecution in the lead-up to the Sodomy II trial.

While wrapping up the defence team's bid to get more proof from the prosecution, Anwar's lawyer Sivarasa Rasiah accused the prosecution of actively trying to bury important records that could prove the opposition leader's innocence, just as it did in the first sodomy trial 10 years ago.

“The danger of suppression of evidence happened in Sukma's case and is happening in this case,” Sivarasa charged today, referring to medical reports on Anwar's Indonesian adopted brother Sukma Darmawan Sasmitaat Madja, which came to light years later and helped clear his name of the crime.

“This application is to prevent that from happening. We can see the resistance,” the Subang MP added, provoking an outcry from Yusof.

Yusof, the Solicitor-General II, denied Sivarasa's claim and insisted that if the view were true, the defence would not have received anything from the prosecution.

“In this case, we have supplied documents so suppression of evidence does not exist,” he said huffily, prompting Sivarasa to stand up quickly to raise a point.

But the High Court judge must have caught a certain look on Sivarasa's face, because he immediately stepped in and cut off both parties.

“Point taken. You're just saying there should be no suppression of evidence, OK?” said Mohamad Zabidin.

The federal lawmaker, however, was dissatisfied with the judge's action and later told reporters that the exchange between him and Yusof “affirms our contention that there is an active political conspiracy” targeted at the PKR leader.

Anwar's other lawyers Edmund Bon and Amer Hamzah Arshad had kicked off today's hearing with their rebuttal against Yusof's reading of the law yesterday, claiming the court has no power to force it to give extra proof.

Taking it in turns, the tag team duo rejected Yusof's view.

Bon insisted the court has a role to play in making sure the accused person's right to defend himself fully is protected, especially when the accused is challenging the prosecution in court for withholding relevant information.

He said the court must not be confused on the type of evidence that can be admitted in the trial, stressing that at the pre-trial stage, the accused has rightsto all material that may help his case, even if the prosecution decides not to use it later on.

“We're not saying these documents should be given more weight now,” Amer added in his turn in arguing to be given the case notes from the doctors and the chemist outlining the way they arrived at their conclusion in the scientific reports.

“A person charged with a criminal offence should be given a fair trial. If he can't be tried fairly, then he should not be tried at all,” he said forcefully.

The hearing resumed this morning without Anwar, who arrived five minutes late with Wan Azizah Ismail and family and supporters.

There were few supporters outside the courtroom, leaving the police to relax its tight security cordon at the court complex in Jalan Duta.

At the outset of the trial this morning, Sivarasa asked the judge to order investigating officer Jude Pereira out of the courtroom as he is a key prosecution witness.

The judge agreed and ordered Pereira out of the room.




Royalty vs Manohara

Manohara, her name is the reason many wore up to the news in the morning, but perhaps her tale is a wake up call for many who feed on this kind of thing.

Make no mistake, issues like this are straining ties between Malaysia and Indonesia. Ambalat may be more substantial but pales to this, being just the icing on the cake. To the general public, the Manohara issue is just too good a scandal not to be made meat of. This is something that the media – both alternative and establishment – have and shall continue to have a field day with. Nothing improves newspaper readership and circulation like a scandal.

After all with sex, kidnap, rape, dramatic rescue, royalty and celebrity model, this story has all the ingredients of a good soap opera, and makes for more than an interesting read.


To the Malaysian Royals, this is another assault on their position and image. Long enshrined in the constitution, the Royals are de facto untouchable, though their conduct of late has come into question. This has led to amendments during the time of Tun Mahathir which saw Royals stripped of their legal immunity, especially in their personal capacities. This has seen some legal actions taken against royalty, the latest of which to a Perak royal for some botched business deal.

But royalty do not have a good image when it comes to men of the royal line and pretty ladies. Probably because of ‘tales’ which harks back to a certain Sultan Mahmud who ‘mangkat dijulang’ (assassinated while on travels.) Rumour mills continue to churn about modern day equivalents, minus the gruesome death part.

As such, the Manohara story may not be something alien to the mind of the people and perhaps to the public relations staff of most palaces in the country. This brings to question the conduct of our royals.

Royalty must re-earn the respect accorded to them by default. In this day and age, they serve a ceremonial and some minute administrative duties. Many of which are just rubber stamp ‘pomp’ for the civil government. Beyond that, they serve no practical purpose other than an additional listing in the country’s budget.

As such the conduct of the royals must be inline with the position and the respect we to accord them. The Manohara case is another point of contention in this issue. The royals need to clear the air over this issue or clean their slate if that is the case.

But on the other hand this is also a time for the royals to state their case. Perhaps they too are victims of schemes by irresponsible parties who aim to profit from them, by association or financially.

This is what the Prince of Kelantan is doing by defending himself and asserting his side of the story, by taking to legal recourse by his own police report in early July and foregoing the media circus route which Manohara has taken.

He is alleging that Manohara’s accusations are false and he is also moving to retrieve some ‘friendly loan’ given to Manohara and her family members amounting up to one million Ringgit.

Although some parties might see any legal recourse as biased as the royals are being said to be under the ‘protection’ of the government in this matter. But contrary to that view is the fact that royals are not immune in their ‘personal’ capacities, which the palace continually stressed this is.

That and the track record of royals who have been dragged before the justice dock in Malaysia and be made accountable for their mistakes. Any legal battle will strictly be between the two parties, assuming both parties engage in it.

For reasons still unknown, Manohara still hasn’t lodge a police report of any sort, nor took any legal action upon her supposed ‘mistreatment’ – other than parading the issue in the media circus that it.

For Manohara, personally, as well as for her ‘advisors’ it is now time to pay the piper. The have spouted their claims all over the place, now it is time to make good on it. They don’t want to be seen to be milking the case for all its worth. After justice is what they want, is it? Not to capitalize on their 15 minutes of fame from this, right?

Where is the evidence you claim to have? Sneak peeks to the media do not count. Documented evidence and validated reports must be made available to the authorities for action.

Cases like rape and abuse requires immediate examination by medical and forensic authorities. This is to ensure the validity of the claims and to make sure that there is no tempering with the goods. Because of the delay in her getting a certified medical examination and indeed in submitting the alleged report, we must consider the possibility of evidence becoming unreliable due to tampering and time.

But more so is the question of whether is there anything for Manohara and her family to show us? If they don’t then we understand – ahem – the delay. If they do have something, why take so long? If they are in the right, then there is no reason for Manohara not to come forward and lodge a report and take legal action. If they are in the wrong then Manohara would need more than just one million Ringgit to pay what the Prince and his lawyers are going to ask for her defamation of him.

Whatever the outcome that will play out, this issue is a wake up call for many. For one is the lifestyle in Indonesia which sees these kinds of things happening. Manohara was still below 18 for goodness’ sake. And she is out and about town, and among islands. Her mother and the Indonesian society may have to realize this and protect their young from being pandered to the rich.

It is also time the royals look to themselves as well. For if the allegations are proven true, then there is much that we must say about the conduct of the royals. No smoke without fire. Enough said. Police thy own before we police it for you.

Ahli Majlis Tertinggi KeADILan Badrul Hisham berkata ini dapat dilihat apabila media cuba mengenengahkan isu puteri Umno jadi mangsa keganasan dengan gambar diambil dari sebuah sebuah hospital.

Turut disirakan seorang petugas Pakatan Rakyat yang turut cedera, berdarah kepalanya dibalut tetapi tidak mahu dihantar ke hospital.

"Inilah bentuk mainan media regim yang tidak layak di ajak berpakat atau berpadu..." katanya dan menambah walaupun berkarung wang ditabur, janji dan ugutan di buat namun BN tetap kalah.

Al-Qaeda vows revenge on China after riots

The violence against the Uigher people has elicited sympathy in much of the Muslim world for the minority Muslim ethnic group who have long faced tight controls on their religious practices


Al-Qaeda has issued its first threat against China with a vow to attack Chinese workers in North Africa in retaliation for Beijing’s treatment of Muslim Uighurs.

The threat, issued by the Algeria-based al-Qaeda in the Islamic Maghreb (AQIM), highlights the risks faced by China as it expands its economic investments overseas.

“Although AQIM appear to be the first arm of al-Qaeda to officially state they will target Chinese interests, others are likely to follow,” an intelligence report from Stirling Assynt, a London-based risk analysis firm, says.

The warning followed deadly unrest in China’s westernmost region of Xinjiang last week, when 184 people died and 1,680 were injured — most of them Han Chinese killed by Uighurs.


The violence has elicited sympathy in much of the Muslim world for the minority Muslim ethnic group who have long faced tight controls on their religious practices, and discrimination. “The general situation (and perceived plight) of China’s Muslims has resonated amongst the global jihadist community,” the report said. “There is an increasing amount of chatter among jihadists who claim they want to see action against China. Some of these individuals have been actively seeking information on China’s interests in the Muslim world, which they could use for targeting purposes.” Stirling Assynt said that its report was based on information from people who have seen the instruction from AQIM.

The al-Qaeda affiliate pledged to avenge fallen Muslims in Xinjiang by targeting the 50,000 Chinese workers in Algeria as well as Chinese projects and workers across northwest Africa. The group has a presence in Algeria, Mauritania, Niger and Mali.

Three weeks ago, AQIM attacked an Algerian security convoy protecting Chinese engineers on a motorway project, killing 24 paramilitary police. While the Chinese were not injured, the assessment notes: “Future attacks are likely to target security forces and Chinese engineers alike.”

Qin Gang, China’s Foreign Ministry spokesman, said that the Government remained opposed to all forms of terrorism. “We will keep a close eye on developments and make efforts with relevant countries to take all necessary measures to ensure the safety of overseas Chinese institutions and people.”

Fears have been mounting among Western counter-terrorism officials that AQIM turned a deadly corner in recent weeks, with a series of fatal attacks on foreigners. Its numbers appeared to have been buoyed by the return of its fighters from Iraqi battlefields, US officials have said.

The Associated Press reported that two extremist Islamic websites affiliated to al-Qaeda had called for the killing of Han in the Middle East, noting large communities of ethnic Chinese labourers in Algeria and Saudi Arabia.

Security remains tight in Urumqi, the capital of Xinjiang, after two Uighurs were shot dead by police yesterday and a third was wounded. Officials said that the men tried to incite a crowd to take part in jihad and tried to assault a guard at a mosque. All mosques are carefully regulated by the Government and worship has been restricted since the July 5 riot. Everyone in the city has been ordered to carry identity cards or driving licences or they will be interrogated.

After the September 11, 2001 attacks on the US, Washington agreed to a request from China and listed an Uighur group called the East Turkestan Islamic Movement (ETIM) as a terrorist organisation. Despite the UN also listing the ETIM as a terrorist group, Western experts see scant signs that terrorist cells operate in Xinjiang, where Sunni Uighurs follow a moderate form of Islam.

Chinese workers, particularly those in Africa, Pakistan and Afghanistan, may be vulnerable to al-Qaeda attack, forcing China to rethink its strategy in a region where it has expanded its interests rapidly in recent years. Kidnapping could become an even higher risk for Chinese, previously targeted usually by mistake or for ransom.

Korupsi Bawah Pentadbiran Najib Makin Parah



Baru melepasi tempoh 100 hari pentadbirannya dalam kerajaan persekutuan, pentadbiran Perdana Menteri Najib Razak semakin parah mengamalkan korupsi apabila menawarkan pembinaan jambatan bagi memenangi hati pengundi dalan PRK Manek Urai.

Tawaran yang dibuat Timbalannya, Muhyiddin Yassin untuk membina jambatan gantung Manek Urai bernilai sehingga RM10juta merupakan bukti jelas rasuah yang diberikan UMNO-BN kepada rakyat.

Ketua Umum PKR Anwar Ibrahim berkata, satu laporan Polis telah dibuat berhubung kejadian itu dan aduan juga telah dikemukakan kepada SPRM untuk menyiasat.

"Kita tengok sejak Najib ambil alih, walaupun beberapa liberalisasi kewangan dibuat. Dari segi media, polis, ugutan, rasuah politik, jaminan pembayaran, lebih teruk dan parah dari dulu. Dalam keadaan itu kita masih bertahan," katanya.

"Nasihat saya pada sahabat saya Muhyiddin, teruskan membina jambatan,"katanya.

Mengulas mengenai jumlah majoriti undi yang merosot, Anwar berakata, keadaan itu tidak menjejaskan PR sebaliknya menunjukkan kekuatan Pakatan walaupun diasak dengan jutaan ringgit yang dijanjikan UMNO.

"Tidak, kemenangan dalam mana-mana pilihanraya, itu menang namanya. UMNO nak kata dia menang dalam kalah atau kalah dalam menang, tidak. Kalah, kalah dan menang, menang. PAS menang," katanya

Katanya, parti komponen PR akan mengadakan pertemuan Jumaat ini untuk membincangkan mengenai perkara berkenaan.

Anwar berkata, BN yang mengatakan mereka mempunyai kemenangan moral dalam PRK Manek Urai tidak layak membicarakan mengenai perkara berkenaan.

Menurutnya, walaupun memperkenalkan dasar liberalisasi namun, Najib tidak langsung menyentuh mengenai korupsi, ketelusan dan kebebsan sistem kehakiman.


Sementara itu, mengulas mengenai tindakan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) menyerbu pejabat ADUN Bukit Lanjan Elizabeth Wong, Anwar berkata, suruhanjaya berkenaan jelas berat sebelah.

"MACC begitulah kalau dipihak pembangkang ada sedikit laporan atau tidak ada diserang begitu. Sistem, tidak berubah, bawah Najib pun malah lebih lagi penguatkuasa dan polis dan SPRM mengambil tindakan yang jelas berat sebelah dan tidak adil.

"Kes berbilion ringgit PKFZ, belian senjata semua ditutup tidak siasat, kita bawa puluhan kes dalam parlimen tidak disiasat. Ini menunjukkan sikap keangkuhan kuasa.

"Saya mengutuk sikap tidak profesional SPRM kendalikan siasatan mereka, menyusahkan pelbagai pihak," katanya.

Ketua Pembangkang Anwar Ibrahim berikrar untuk melawan apa sahaja cubaan kerajaan pusat menghancurkan Pakatan Rakyat.

"Kita akan menjadikan ia sukar untuk mereka, kita akan lawan mereka di setiap peringkat," kata Anwar di Kompleks Mahkamah Jalan Duta hari ini.

Mantan Timbalan Perdana Menteri itu melahirkan rasa marah beliau kepada usaha Perdana Menteri Najib Abdul Razak untuk mengertak pihak pembangkang.

Beliau berkata demikian selepas mahkamah menolak permohonan pasukan pembelaan untuk mencari ketua pembelaan baru, selepas peguam veteran Sulaiman Abdullah dimasukkan ke hospital semalam.

"Sistem ini masih mendokong kezaliman. Kita perlu ubah sistem ini," tegas Anwar.

Beliau berkata pentadbiran Najib mencabul institusi awam seperti badan kehakiman dan suruhanjaya pencegahan rasuah untuk kepentingan politik, mengancam pemimpin-pemimpin pembangkang atas tuduhan yang tidak berasas.

"Adalah hak kamu untuk mendapatkan perbicaraan yang adil, hak kamu untuk dilindungi dari samseng dan ah long, tetapi bagaimana pula dengan PKFZ (Zon Bebas Pelabuhan Klang)? Kemana siasatannya?" kata Anwar kepada Umno-BN dan Najib.

"Kamu ingat kamu boleh bisukan pembangkang dengan menakut-nakutkan saya? Kamu ingat dengan mengasari Anwar seperti ini, Anwar akan berdiam diri? Kamu sudah salah, kita akan terus laksana hak kami bersuara untuk rakyat," sumpah Anwar.

Kemana Perginya Laporan Perubatan Hospital Pusrawi?

Pendakwaraya berkata pihaknya tidak mempunyai laporan perubatan Hospital Pusat Rawatan Islam (Pusrawi) Kuala Lumpur keatas penuduh, Saiful Bukhari Azlan.

Menurut laporan itu, Saiful mengadu mengalami tenesmus iaitu kesukaran dan kesakitan ketika membuang air besar. Setelah diperiksa Dr Mohamed Osman, di dapati dubur Saiful “tidak mengalami pendarahan aktif”, “tiada kesan ulser atau nanah” dan “tiada kesan koyak atau calar”.

Dr Mohamed Osman memeriksa penuduh beberapa jam sebelum membuat Saiful laporan polis terhadap Anwar pada 28 Jun tahun lalu. Saiful mendakwa dia telah dirogol, sebelum pendakwaraya menukar tuduhan kepada sukarela.

Pendakwaraya juga berkata pihaknya telah menyerahkan laporan perubatan Hospital Kuala Lumpur kepada pasukan pembelaan.

SPRM serbu pejabat exco kerajaan negeri Selangor

Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) menyerbu pejabat pengerusi Jawatankuasa Tetap Pembangunan Kampung Baru dan Penyelesaian Kilang Haram, Ean Yong Hian Wah yang didakwa menggunakan wang rakyat untuk memberi sumbangan.

Serbuan tersebut telah dilakukan oleh lima orang pegawai SPRM dari Putrajaya dan Selangor pada jam 3.30 petang.

Beliau mempertikaikan tindakan pihak SPRM yang mengambil semua fail peruntukan mereka untuk disiasat tanpa sebarang surat kuasa untuk mengeledah pejabat exco.

Namun begitu, tiada sebarang dokumen kerajaan negeri diambil oleh pihak SPRM disebabkan kehadiran pihak media yang terlalu ramai di pejabat beliau.

Pihak SPRM, menurut Ean, enggan menunjukkan kad kuasa mereka ketika diminta dan juga tiada sebarang notis atau waran untuk membuat serbuan di pejabat exco.

Terdahulu, SPRM juga telah menyerbu Pejabat Khidmat Masyarkat Adun Seri Kembangan, pada jam 11 pagi tadi yang dilakukan oleh lima orang pegawai dari Putrajaya dan Selangor.


Beliau juga merupakan Adun Seri Kembangan, berkata, siasatan mengejut SPRM ini adalah ekoran daripada penyiasatan sumbangan parti kompenan Pakatan Rakyat, DAP yang menyampaikan sumbangan kepada sebuah masjid di Puchong.

Sebelum ini, penyerbuan pihak SPRM ini merupakan ekoran dari siasatan tujuh orang Adun Selangor berhubungan dengan sumbangan RM 10,000 kepada sebuah masjid di Puchong bagi membeli pembesar suara.

Tujuh Adun tersebut ialah Adun Kinrara, Elizabeth Wong, Adun Kampung Tunku, Lau Weng San, Adun Subang Jaya, Hannah Yeoh, Adun Bukit Lanjan, Elizabeth Wong, Adun Bukit Gasing, Edward Lee Po Lin, Adun Damansara Utama, Dr Cheah Wing Yin dan Adun Seri Kembangan, Ean Yong Hian Wah.

Exco Pelaburan, Perindustrian dan Perdagangan, Teresa Kok dalam sidang media yang diadakan baru-baru ini di bangunan Annex, berkata tindakan itu tidak wajar kerana sumbangan ini adalah bagi faedah kegunaan rakyat.

"Kami berasa aneh kenapa hanya dokumen peruntukan kami, ketujuh-tujuh Adun kami diambil oleh pegawai SPRM.

"Dan juga saya rasa aneh yang mana dalam kes saya yang mana saya beri sumbangan 10 ribu ringgit untuk satu surau di Puchong untuk beli pembesar suara,"katanya.

Pertarungan Tuntut Bukti Bermula, Anwar Sakit Dibawa Keluar

Pertarungan antara Anwar Ibrahim dan Kerajaan Malaysia menuntut supaya pendakwaraya menyerahkan bukti-bukti penting kepada pasukan pembelaan bermula dengan peguam Edmund Bon mengetuai pasukan pembelaan.

Dalam penghujahan beliau di hadapan Hakim Zabidin Md Diah, Edmund berkata kerajaan telah berlaku salah kerana pihak pendakwaraya harus menyerahkan bukti-bukti itu tiga minggu sebelum perbicaraan bermula, bukan semasa perbicaraan berlangsung.

Edmund berkata pihak pendakwaraya tidak perlu berdolak-dalik lagi kerana pasukan pembelaan menuntut bukti-bukti yang spesifik seperti sedutan rakaman kamera litar tertutup (CCTV) di tempat kejadian, akuan saksi dan laporan perubatan.

Bahkan, pihak pendakwaraya tetap tidak mengendahkan amalan perbicaraan kerana sehingga ke hari mereka tidak mengumumkan senarai saksi dalam perbicaraan Anwar.

Edmund menambah sekiranya hakim menolak tuntutan undang-undang supaya pihak pendakwaraya mendedahkan semua bukti dan saksi di tangan mereka, pihak pendakwaraya tidak boleh membawa masuk bukti yang tidak diserahkan dalam masa tiga minggu sebelum perbicaraan.

Peguam Amer Hamzah Arshad kemudiannya mengambil-alih dan mengemukakan tuntutan keatas nota pakar kimia kepada mahkamah.

"Pihak pembelaan perlukan nota pakar kimia keatas DNA untuk menentukan metodologi kajian dan kesimpulan kajian, bagi memastikan perbicaraan yang adil," tegas Amer.

Amer Hamzah menyorot perhatian mahkamah kepada perilaku jahat pendakwaraya dalam kes Liwat I: pihak pendakwaraya menyembunyikan laporan perubatan yang melaporkan bahawa Sukma Darmawan tidak mempunyai kesan tusukan pada dubur.

Pada ketika ini Anwar mengadu kesakitan, dan beliau dibawa keluar dari mahkamah.

Pihak pendakwaraya berkata pasukan pembelaan tidak berhak kepada sampel dan sisipan darah.

Khir digantung setahun empat Adun BN enam bulan



Dewan Negeri Selangor meluluskan usul terhadap Ketua Pembangkang, Dato' Seri Dr Mohd Khir Toyo digantung berkhidmat sebagai Adun dan dipotong semua elaun serta kemudahan bulanan selama setahun.

Timbalan Speaker, Haniza Talha telah memaklumkan keputusan tersebut sekitar jam 3 petang selepas usul tersebut dibahaskan dan mendapat sokongan majoriti di Dewan Negeri Selangor.

Berikutan itu, 18 Adun BN yang merupakan pembangkang di Selangor diketuai Khir Toyo bertindak keluar Dewan sebagai memprotes usul meluluskan cadangan hukuman itu telah dibuat dan dipersetujui oleh Jawatankuasa Hak dan Kebebasan Dewan (JKHK).

Jawatankuasa itu turut menggantung empat Adun BN dengan dipotong elaun dan kemudahan bulanan selama enam bulan.

Ahli Dewan tersebut; Dato' Warno Dogo (Sabak-Umno); Mohd Isa Abdu Kasim (Batang Kali-Umno); Dato' Marsum Paing (Dengkil-Umno) dan Dato' Mohamed Idris Abu Bakar (Hulu Bernam-Umno).


Usul yang dibawa oleh Lau Weng San (Kampung Tunku-DAP) menegaskan hukuman yang dikenakan keatas lima orang Adun itu berbeza dengan hukuman yang dikenakan ke atas Adun dan Ahli Parlimen Pakatan rakyat lalu.

"Saya telah meneliti penyata Jawatankuasa Hak dan Kebebasan Dewan Negeri telah mengetahui bahawa Jawatankuasa telah diadakan dan satu sesi pendengaran dipanggil untuk lima orang Adun terlibat membela diri," jelasnya.

Beliau berkata, semua Adun terlibat diwakili tujuh orang peguam dan mereka telah mengemukakan bantahan dan tidak mengambil keputusan untuk membela diri.

Usul tersebut disokong oleh Ng Sue Lim (Sekinchan-DAP) yang menegaskan Speaker tidak terlibat dengan cadangan memutuskan hukuman penggantungan terhadap Khir Toyo dan empat Adun BN yang lain.

Penegasan beliau itu berikutan dakwaan Khir bahawa penggantungan perkhidmatan Adun selama setahun itu dilakukan oleh Speaker dengan niat jahat dan balas dendam.

Sementara itu, Adun (Meru-PAS), Dr Rani Osman mengingatkan Khir supaya jangan bersikap mendabik dada dengan menganggap kekayaan yang diperolehi adalah hasil titik peluhnya.

Dengan kekayaan itu katanya, Khir boleh melakukan apa saja tindakan dan lebih parah menggunakan kuasa untuk menindas golongan bawahan tanpa mengira orang Islam atau bukan Islam.

Beliau berkata demikian ekoran kenyataan Khir yang mendabik dada kewajarannya untuk tinggal di rumah besar kerana sebagai bekas Menteri Besar dan tidak sesuai tinggal di rumah pondok.

Menurut beliau, pondok itulah yang telah mengeluarkan ramai para ulama, pencinta negara dan pejuang yang telah mengorbankan jiwa mereka untuk tanah air.

Beliau turut menyelar sikap Khir yang melemparkan fitnah bahawa kerajaan Pakatan Rakyat banyak berbohong dengan rakyat dalam melaksanakan pentabdiran.

"Saya hendak tanya adakah Sungai Panjang mengetahui bahawa rakyat hari ini masih rakyat yang lama, yang tidak tahu ICT, rakyat hari ini telah berubah," tegasnya.

Bagi Shaari Sungib (Hulu Kelang-PAS) mengingatkan Khir Toyo supaya segera bertaubat kerana enggan menjadi saksi telah mengakibatan dosa besar.

Ini kerana katanya, wakil rakyat merupakan pembela hak rakyat dan menjadi saksi utama adalah fardhu ain yang sangat dituntut dalam agama Islam.

Ekoran tindakan Khir yang keluar dewan beliau menegaskan, itu membuktikan kegagalan BN mendukung prinsip Islam telah terdedah di sidang Dewan Negeri.

Menurut beliau, apabila seseorang itu enggan menjadi saksi satu penyakit lain telah timbul iaitu beliau cuba memutar belit dengan membawa keterangan yang tidak sewajarnya.

"Kita telah menyaksikan beliau (Khir) memutarbelitkan fakta walaupun beliau telah diberi peluang seluas-luasnya dengan notis pemberitahuan peguam tetapi beliau enggan datang dalam siasatan Selcat," tegasnya.

Beliau mengingatkan Khir bahawa tindakannya itu bukan saja telah melakukan penghinaan terhadap Dewan tetapi telah melakukan dosa kepada Allah kerana enggan menjadi saksi dan memutarbelitkan fakta dan berbohong.

"Saya seru beliau bertaubat dan memperbaiki diri," katanya.

Menurut beliau, 18 wakil rakyat BN yang turut keluar dewan membuktikan bahawa mereka bukan saja tidak bersedia untuk mempertahankan hak rakyat tetapi curang dan cuai terhadap rakyat.
